Security Review

This project was initiated to address the aviation security issues identified by the Domestic Security Review.  The outcomes of the Review prompted Cabinet to require specific regulatory action with regard to strengthened flight deck barriers on aircraft of more than 30 passenger seats that operate domestically, the establishment of security committees at all airports that service regular air transport passenger services on aircraft of 19 or more passenger seats, and to enhance the education and training for airline and airport staff.

In addition, the CAA proposes to resolve three issues relating to ICAO compliance that can be addressed concurrently as part of this rule project (provided they do not impede implementation of the measures required by Cabinet).  Those issues relate to vehicle security identification systems, security controls for international transit operations, and operations under the Australia New Zealand Aviation (ANZA) Mutual Recognition Principle in respect of Part 108 Security Programmes.

ICAO - Equipment Compliance

This project will update the instrument and equipment requirements in Part 91, Part 121, Part 125, and Part 135 by aligning the rules with current ICAO standards and recommended practices, as well as the requirements of other National Aviation Authorities.  The proposed rules amendments will primarily apply to international commercial air operations.

The issues that will be addressed include – IFR sensitive pressure altimeters; the specification for LOC and VOR receivers; FDR/CVR system requirements; FDR parameters; ACAS II for Part 91 operations; forward looking wind shear warning systems; equipment for single pilot IFR/night operations; and the requirement for two landings lights for night operations.

Safety Management Systems - Group 1 Rule Project: Nominations for Project Working Group

The objective of this project is to introduce rules for organisations certificated under Parts 119, 129, 139, 145 and 172 to establish, implement, and maintain Safety Management Systems appropriate to the size and scope of their organisations.

ICAO Part 139 Review Project

On 11 Nov 2008, the CAA released the Project Scope Statement titled ICAO Part 139 Review. The objective of this project is to carry out a review of   Part 139 Aerodromes – Certification, Operation and Use by addressing the issues raised in the recent ICAO safety audit of the CAA, issues raised by industry, and by updating the rule in a manner that achieves the greatest compliance with Annex 14 specifications for aerodromes.

The ICAO Part 139 Review Project Working Group (PWG) members and observers were announced on 20 Feb 2009. As outlined in the Terms of Reference for the Project Working Group (PWG), the purpose of a PWG is to provide the CAA, and the Rules Project Specialist assigned to manage the rule project, the necessary technical and other specialist input, including information and data, required to develop rule proposals.

Part 137 - Agricultural Aircraft Operations

The purpose of this project is to address a series of issues which propose changes to operator certification, overload weight determination, determination of hopper contents, shoulder harnesses for passengers and the definition of agricultural operations.

Part 115 Adventure Aviation

The purpose of this project is to introduce a new framework of rules that are applicable to operators (other than air transport or commercial transport operators) wishing to conduct operations using aircraft by carrying passengers for hire or reward.

Part 115 will control operator entry and exit from the system, equipment requirements, maintenance requirements, routine and emergency procedure requirements, training and experience requirements, and operator surveillance requirements.

The types of operations to be covered by Part 115 include:

  • an A to A flight in an aeroplane or helicopter issued with a standard category airworthiness certificate conducting formation flight, aerobatic manoeuvres, and similar non-standard flight manoeuvres such as steep climbs, steep descents, and steep turns;
  • an A to A flight (including an interim water landing for amphibious aircraft) in an aircraft issued with an appropriate special category-primary, special category-LSA, or special category-limited airworthiness certificate;
  • an A to A flight in a Class 2 microlight aircraft;
  • a flight in a hot air balloon;
  • a flight in a glider;
  • a parachute-drop aircraft operation that is not conducted under the authority of an air operator certificate issued under the Act and in accordance with Part 119;
  • a tandem parachute operation;
  • a tandem hang glider flight.

The Project Working Group is being re-engaged to provide technical input to the Rules Project Specialist during the NPRM production phase.

Part 121 and 125 Air Operations – Large and Medium Aeroplanes

This project has now been split into two different projects:

  • 6/CAR/5 Part 121 Air Operations (Large Aeroplanes); and
  • 10/CAR/1 Part 125 Air Operations (Medium Aeroplanes).

Review of Subparts H, I, and J - Project Working Group (PWG)

The Project Scope Statement was released on 24 May 2007. The objective of this project is to review Subparts H, I, and J of Parts 121 and 125. More specifically, the project will aim at:

  • aligning Part 121 with Part 125 rules to comply with ICAO and International current aviation standard practices
  • establishing new rules that will govern:
    • pilots operating more than one aeroplane type or variant; and
    • duties and qualifications of a Cruise Relief Pilot
  • reviewing and standardising certain rules within Part 121 and Part 125 in response to a number of exemptions the CAA received dating back to 1998
  • clarifying rule requirements as part of a larger overall review of Subparts H, I, and J so that these rules are transparent and readily perceived and understood by all interested parties
  • ensuring compliance with the legislative requirements for the Minister of Transport Safety to make rules that take into account the requirements of the Act.

A Project Working Group has been developed and consists of airline representatives specific to flight operation, pilot training and cabin crew standards and procedures for Parts 121 and 125 Operators. The PWG will assist the CAA Rules Project Specialist in accordance with the Terms of Reference for the Project Working Group. The next step is to liaise with the PWG on updates of the rules and issues under review together with comments provided by the previous PWG and proposals under consideration by CAA.
